CONSISTENCY AND COHERENCE IN ADJUDICATING THE ECB'S UNCONVENTIONAL MONETARY POLICY

Abstract Few court cases in the history of European integration have been more controversial than decisions Court Justice EU and German Federal Constitutional on Central Bank's public sector asset purchase programmes. This article regards consistency coherence case law as uncontroversial minimum conditions that to be satisfied for gain legitimacy. It assesses against this benchmark determines limits programmes under a consistent coherent application legal tests developed by courts.
